a) It is the responsibility of the Primary Guest to ensure that all Guests abide by this Rental Agreement.
b) The Primary Guest agrees that the information provided on the online booking for is true and accurate.
c) This Agreement will be binding, enforceable and take effect once the online booking application is approved and payment has cleared banking procedures.
d) You are agreeing with the Terms and Conditions and as such, you, the Primary Guest, acknowledge and confirm that you have read and agree to all Terms and Conditions within the Rental Agreement.
e) All cottage rules must be followed. If you or a Guest violate said rules, it may result in a forfeit of the Security Deposit (portion or full) or you may be asked to vacate the premises.
2. PROPERTY INFORMATION:
a) There will be a Property Information package at the cottage which will describe how things work, how to use the septic system, a description of the water system, where you can find cleaning supplies and information about garbage disposal.
3. PROPERTY CONDITION:
a) The property, all furniture, appliances, equipment, fixtures and effects in or about the premises, will be maintained in the same state and condition as found at the beginning of the rental.
b) The property must be cleaned for the next guest upon departure as per the Property Information package, failure to do so will result in cleaning fees being deducted from the Security Deposit.
c) Any part or portion of the property, or any part or portion of furniture, appliances, equipment, fixtures or any effects in or about the premises that are damaged or destroyed will be deducted from the Security Deposit and/or additional payment request.
d) Any damage(s) or concern(s) discovered upon arrival to the rental property shall be documented and reported immediately. It is strongly recommended that all guests conduct their own survey/assessment of the rental upon arrival.
4. PROPERTY USE:
a) The number of Guests on the property shall not exceed the number stated (at any given time) in the online booking application that was submitted and accepted at the time of booking.
c) Camping, tenting or other auxiliary accommodation is not permitted on the property.
5. PAYMENT INFORMATION:
Payments can be made using one of the following methods:
a) Online e-Transfer (please send to email@example.com with booking id as reference)
b) A certified cheque or money order in Canadian funds (please request address via email)
c) Visa or MasterCard through Stripe with a convenience fee of 3% of the amount
6. SECURITY DEPOSIT:
a) All bookings require a $300 Security Deposit which is requested upon booking. The Security Deposit will be returned to you within 7 days of the check-out date.
b) If there is any damage, extra cleaning or garbage removal required and/or any other penalties as per this Rental Agreement they will be subtracted from the Security Deposit and the balance, if any, will be returned to you along with an invoice for those charges. For issues that exceed the Damage Deposit an additional request will be made for payment.
7. PAYMENT DATES:
a) The refundable Security Deposit is required upon reservation being received and accepted by Owner.
b) 50% of the rental fee is required 16 weeks prior to the check-in date.
c) The remaining balance is required 6 weeks prior to the check-in date.
d) Once a reservation is received and accepted by the Owner, the Guest is liable for payment of the balance of the rental fee and Security Deposit by payment due dates. Non-payment will be treated as a cancellation (see section 21) and a cancellation fee will be charged.
8. CHECK IN/OUT:
a) Check-in time is 4:00 pm.
b) The property will be promptly vacated at the end of the rental period, as per the designated check-out time (10:00 am). Failure to do so will result in a deduction from the Security Deposit..
Guest(s) are required to supply bed linens, pillowcases, towels, face cloths, dishcloths and tea towels.
The Guest(s) shall leave the property in the same state of cleanliness and general order in which it was found. Failure to do so to the satisfaction of the owner may result in a deduction from the Security Deposit.
a) The Guest shall remove all garbage & recycling from the property (interior & exterior) and dispose of accordingly, after their departure. Failure to remove any waste material will result in a reduction from the Security Deposit.
b) The guest shall not leave any garbage outside during their stay to avoid attracting wild animals.
12. DRINKING WATER:
Water is supplied from a drilled well that is suitable for drinking. However, if you have any concerns it is recommended that you bring drinking water.
a) One pet is permitted on the property if they are indicated on the online booking application form and approved by the Owner.
b) All evidence of pet occupation must be removed from the property at the end of the rental period. Failure to do so will result in a reduction from the Security Deposit.
c) Pets may not be left in a cottage or unattended on the property at any time.
d) Pets must be on a leash or tethered while at the cottage and must remain within the property boundaries. Repeated wandering and/or excessive barking may result in neighbouring properties notifying local bylaw officers.
e) The owner accepts no responsibility for any allergic reaction or other conditions arising at the property.
a) You are responsible to check with local authorities for information on fire permits, fire bans and or fire restrictions before you start any outdoor fires.
b) Campfires are only permitted in designated areas as defined in the Property Information book.
c) Wood should be locally sourced and must be supplied by Guests.
a) Use of fireworks is not permitted within the boundaries of the property. Failure to comply with this may result in eviction without refund plus any damage fees and bylaw fines.
a) Smoking is not permitted inside the cottage.
b) Smoking is permitted outdoors, however butts must be contained in a fireproof container which should be removed when you leave. Any clean up and/or fumigating of the property will result in a reduction from the Security Deposit.
At the end of the rental period, return all keys to the lock box located on the cottage door. Forgetting to leave the
key in the lockbox or loss of keys will result in a reduction from the Security Deposit.
The Owner or their designate shall be allowed access to the property during your occupancy for emergency repairs.
a) Every effort will be made to ensure that all the fundamental equipment at the property is in good working order at the time of your arrival.
b) In the unlikely event that there is a problem with the water, plumbing, electrical system or a major appliance upon your arrival or during your stay, call the Owner or primary contact in accordance with the Property Information book.
b) It is the Owner’s intent to address issues as promptly as can be reasonably done. If such fundamental elements or services cannot reasonably be provided, the sole obligation of the Owner shall be to provide a refund as deemed appropriate with the circumstances.
c) Recreational items such as kayaks, trampoline, slides, television, radio, DVD player, and other such recreational items are provided at the discretion of the Owner as an added feature for the Guest(s) use. While every attempt will be made to ensure that such equipment is available and in working order, should breakdown or some other situation occur whereby these elements are not available or not working, the Owner shall not be responsible for replacing or refunds.
d) The information contained in any printed materials or web site is believed to be accurate at the time it is created. The Owner reserves the right to make alterations and will inform you of such alterations, however the failure to do so shall not form a breach of the Rental Agreement or relieve you of your obligations under this Rental Agreement.
20. CANCELLATION BY OWNER:
In the unlikely event that the cottage is struck by disaster, then, the Rental Agreement will be null and void and all payments will be immediately refunded.
21. CANCELLATION BY GUEST:
a) If the Primary Guest wishes to cancel the Rental Agreement the owner must be notified.
b) If the cancellation is received 6 weeks prior to the check-in date, then all deposits will be refunded, less a cancellation fee of 10% of the rental fee.
c) If the cancellation is received less than 6 weeks prior to the check-in date, the Owner will endeavor to find a replacement booking for the same period and if successful then all deposits will be refunded, less a cancellation fee of 10% of rental fee. If a replacement booking cannot be made then no refund will be made.
You agree that you shall not be entitled to any refund arising from weather or water conditions, changes or fluctuations in the lake level, conditions at neighbouring cottages or other conditions beyond the control of the Owner.
23. LIMITATION OF LIABILITY:
The Guest(s) acknowledges that the Owner accepts no liability for loss, damage, death, illness, or injury suffered by any person or pet as a result of using this property. You agree that such liability rests entirely with the Primary Guest.
The Primary Guest acknowledges that the use of the cottage by all Guests is entirely at your own risk. The Primary Guest shall indemnify and hold harmless the Owner against all expenses, costs, damages, suits, actions or liabilities arising from all loss of or damage to the cottage, injury, personal condition or death resulting from the use of the cottage, grounds, boats or lake.
You represent and warrant that you carry proper insurance. The Owner does not carry insurance on the valuables, or clothing of the Guest(s) or for any willful damage caused by the Guest(s). It is therefore the Primary Guest’s responsibility to insure against any unforeseen damage or loss of any Guest(s) possessions and damage to the cottage caused by any Guest. If you have a Home Owner’s policy, you may be covered under that policy for short-term rentals such as this one. You should check with your Insurance Agent for details.
The laws of the Province of Ontario and bylaws of the Municipality of Hastings Highlands shall govern Rental Agreement. It is the Guest(s) responsibility to be informed, especially with noise, fire, licensing and operating regulations.
You have no right to assign or sublet this Rental Agreement under any circumstances.
28. FORCE MAJEURE:
The Owner is not responsible for failure to service this Rental Agreement if the failure arises out of causes beyond their control including water levels, hydroelectricity failures, severe storms, acts of God or any other cause whatsoever beyond their control.
